TYPES OF CHILD CUSTODY

1) Joint Custody: this is where both parents have joint legal and joint physical custody.

2 ) Physical Custody: basically who the child(ren) physically live with.

a ) Sole Physical Custody: meaning the child(ren) physically lives with only one parent. The non custodial parent normally receives visitation periods with the child.

b ) Joint Physical Custody: meaning the child(ren) lives with one parent some percentage of the time; then the other parent the other percentage of the time.

3 ) Legal Custody: basically who has the right and responsibility for decision making concerning the child(ren), including, but not limited to,education, health care, religion, etc.

a ) Sole Legal Custody: meaning only one parent has the rights and responsibilities of making decisions concerning the child.

b ) Joint Legal Custody; meaning both parents have the rights and responsibilities of decision making concerning the child.

Child Born During Marriage: The issue of child custody is always the most emotional aspect of a divorce. In the case of divorce, generally, the court having jurisdiction of the divorce proceedings also determines who shall have custody of children from the marriage. It is crucial to have the correct custody established during a divorce proceeding, or you could loose important rights to your child.

Child Born Out -of-Wedlock: If the Mother and alleged Father were not married at the time the child was born, then paternity must be determined before custody can be established. Paternity in some cases have to be established by genetic (DNA) testing.
