CHILD SUPPORT

Child support in Alabama is based on both parents GROSS income. If one parent is not employed his/her income can be assessed at minimum wage or based on their income earning potential due to past income history. If a parent is voluntary unemployed or voluntary under employed their income can be assessed at their income earning potential.

The amount of child support paid by each parent is governed by Rule 32 of the Alabama Rules of Judicial Administration. These rules are set up as guidelines, only. But the courts strictly adheres to these guidelines, and only deviate from the guidelines on a case by case basis and only in financial hardship situations. In Alabama the non custodial parent has to pay some amount of child support. If the non-custodial parent can prove to the court that following the Rule 32 Guidelines will cause a substantial financial hardship upon him/her then the judge has the discretion to create a downward departure from the child support guideline amount.

There are many other charges and credits that comes into play when calculating child support amounts. Therefore, it is highly recommended that you contact the Firm or a competent family law attorney. If not, you may wind up paying much more that your obligation, which can add up to many thousands or tens of thousands of dollars over the years.  Also, on the flip side if you need to have child support set against the other parent, you would be wise in contacting the Firm or a competent family law attorney. NON PAYMENT OF CHILD SUPPORT (Contempt)

If the paying parent does not follow a child support order he/she can be held in contempt of court. If Thirty (30) days has past since the date the paying parent should have preformed under the court order the receiving parent can file for contempt. If the court finds that the paying parent is in contempt, the court can order the paying parent to reimburse the receiving parent his/her legal fees.

If the paying parent is found by the court to be in contempt there are a number of remedies / actions the Judge can take. Examples are: fines, jail time (up to five days per contempt charge), suspension of professional licence, and paying on the child support arrearage.

The paying parent can purge his/herself of such contempt before going to court by bringing the child support arrearage up-to-date.

AMENDING CHILD SUPPORT AMOUNTS
Grounds for amending child support: 1. Your income or the other parent's income has increased or decreased by 10% ; 2. One of the children has reached the age of majority, has married or become emancipated. 3. The paying parent's inability to pay due to financial hardship.
