Non-Contested Divorce

What is a non-contested divorce ?  A non-contested divorce is where you and your spouse have discussed the issue of divorce and both of you have agreed on the terms of the divorce.

For example: who gets what property; who is to pay what debts; child custody; child visitation; etc.

Pros :  Quick, inexpensive and only one attorney needed*. No court appearances.

              *(NOTE: The attorney can only represent you or your spouse. Not both you and your spouse. IF you are represented by the attorney your spouse does have the right to an attorney if they so choose, but it is not necessary. If you are on the "receiving end" of a non-contested divorce, it is strongly advised to seek legal counsel for yourself.)

Cons:  If one spouse refuses to sign the non-contested divorce documents, you will need to file a contested divorce.

Contested Divorce

What is a contested Divorce ?  Simply put ;  A contested divorce is where you and your spouse can not agree on the divisions of marital assets and debts or the issues involving the children.         

Pros: You get to have your day in court to fight for your legal rights. If you and your spouse can not agree to the division of assets, debts and child issues, you have a judge who will hear your side of the story, weight the evidence presented, use his/her wisdom and power to make a fair and equitable division of the martial issues.

Cons: Contested Divorces are lengthy and costly legal processes. The outcome may not be as favorable to you as expected. Contested Divorces are most often more emotional and stressful.

Grounds For Divorce
1. Incapacity; 2. Adultery; 3. Abandonment; 4. Imprisonment; 5. Crime Against Nature (with mankind or beast); 6. Habitual Drunkenness or Drug Addiction; 7.Incompatibility of Temperament; 8. Mental Incapacity / Insanity; 9. Irretrievable Breakdown; 10. Pregnancy; 11. Violence / Cruelty; 12. Non-Support and Separation .
