PREPAID LEGAL PLAN

In his practice of law attorney Mitch McBeal began to realize that due to the large cost associated with legal fees and expenses most middle class people were unable to afford to pay an attorney to protect their rights. People in the upper income level have no problem consulting with an attorney and most have an attorney on retainer so legal advice is just a phone call away. On the other end of the income spectrum, people on the bottom income level have government programs which provide them with legal representation. That leaves the middle class income people without legal representation or indebted to the attorney they retain.

You have health insurance to cover your medical expenses and pay the large cost associated with doctor fees in case you or a family member becomes sick. You have car insurance to cover the high cost of repairing your car in case of an accident.

As a member of The McBeal Law Firm, LLC Prepaid Legal Plan you will have access to an attorney without having to worry about searching for an attorney and paying high fees.

This plan is right for you if :

* You have ever needed to consult with an attorney regarding an legal issue but decided not to because of the cost;

* You have ever needed to consult an attorney regarding terms or clauses in a contract or other legal document;

* You have ever needed a will drafted or revised ;

* You have ever called an attorney to learn what your rights are in a certain matter or issue, but have the attorney ask for a           consultation fee.

* You want to have an attorney on retainer, who will have your best interest in mind.

As a member of The McBeal Law Firm, LLC Prepaid Legal Plan you have an attorney on retainer with whom you can consult with ;without incurring large legal fees.

 

PERSONS COVERED UNDER THE PLAN

You as the primary member

Your spouse (for an extra $1.00 monthly fee) ( See exception A )

Your children, who are under the age of 19, or regardless of age who has a mental or physical disability (for an extra $1.00 monthly fee).


COST OF THE PLAN

Membership fees are $26.50 per month for your primary membership. That's $318.00 per year for your membership.

Member and spouse coverage $27.50 ( $330.00 per year )

Family coverage $28.50. ($342 per year )

Emergence ( after regular business hours ) access, additional $1.00 per month fee.

Attorneys ask for retainer fees any where from $500.00 for simple legal matters to many $1,000.00's for more complicated legal cases. And those fees only cover one legal issue.


PLAN PAYMENT METHODS

1. Payroll deductions by your employer. Just like your health and other insurance; or

2. Direct withdrawals from your checking or savings account; or

3. Direct payments from your credit card.

4. One time annual payment.

LEGAL PLAN COVERAGE

Phone Consultations between Firm attorney and member.

Members can consult with a Firm attorney regarding any personal or business related matter.

Firm attorney representational phone calls and letters on behalf of member.

In some matters a phone call or letter from your attorney can resolve the issue. Members get one call or letter from a firm attorney to an adverse party per specific matter. Additional consultation and legal representation for the specific matter will be discounted 25% from regular Firm fees*.

 

Contract / Document Reviews

Members can have up to 12 legal documents reviewed per year , limited to 10 pages per document. Additional legal documents and those over 10 pages will be discounted 20% from regular Firm fees*.


Wills and Trusts

Primary Member receives one simple Will or simple Will update per year. Wills or will update for plan covered family members $50.00. Advanced Will preparation receives a 20% discount from the FIRM's per hour probate rate*. Trust preparation will be discounted 20% from regular FIRM per hour probate rate*.

Criminal Defense

Includes misdemeanor and felony charges. ( 10 hours of attorney time free, plus 20% discount of regular firm fees after the 10 hours. ) A retainer maybe required for services under this benefit. Plan does not include traffic offenses. DUI representation $85.00 hour.


Civil Matter Defenses

( 10 hours of attorney time free, plus 20% discount of regular firm fees after the 10 hours. ) A retainer maybe required for services under this benefit.


Civil Plaintiff Representation

( 10 hours of attorney time free, plus 20% discounts of regular firm rates or discounted contingency fees from regular firm rates.)

Any legal representation not specifically mentioned in this plan maybe negotiated at reduced fees between FIRM and primary member.

The member will be responsible for Firm's Expenses incurred in connection with representation and shall remain the sole responsibility of member to pay in advance or to reimburse Firm when billed . Expenses include , but are not limited to: long distance telephone calls, fax charges at $1.00 per page received, inter-office document copy fees at .25 cents per page , any other document copy fees incurred, parking tolls & tickets, air fare, court cost, deposition expenses, medical records charges, postage & certified mailings, courier fees, vehicle mileage at .36 cents per mile and travel time.


LEGAL PLAN BENEFITS



CONFLICTS BETWEEN MEMBERS

The FIRM will not represent a member if the representation will be directly adverse to another member ; unless : The Firm believes the representation will not adversely affect the relationship with the other member and each member consents to the representation in writing after consultation between the FIRM and possible conflicting members.

The FIRM will not represent a member if the representation may be materially limited by the FIRM's responsibility to the other member or the FIRM's interest; unless : The FIRM believes the representation of the members will not be adversely affected and the members consent in writing after consultation with the FIRM.

Consultation will include explanations of the implications of any common representation by the FIRM and include the advantages and possible risks involved. The consultation between the FIRM and members will be geared toward allowing the members to make an informed and knowledgeable consent to the representation.

If members after consultation elects not to be represented by the FIRM ; The FIRM upon request will refer the members to competent attorneys.

If one member in possible conflict with another member decides not to be represented by the FIRM or if the FIRM determines an adverse conflict may occur ; the FIRM will not represent ether member.

The FIRM reserves the right not to represent a member which the FIRM concludes that a conflict will possibly occur. The FIRM reserves the right not to explain the detail reasons in which a conflict arose.

A member may consent to representation notwithstanding a conflict. However, with respect to representation directly adverse to a member and with respect to material limitations on representation of a member ; When a member receives advice from a disinterested lawyer, which concludes the member should not agree to the representation by the Firm, under the circumstances, the FIRM will not ask for the member's consent for the FIRM's representation.

The FIRM will not represent members who are opposing parties in litigation matters.

In all situations where members are or may be adverse to each other in legal matters, the FIRM will consult with the members and representation or non-representation will be controlled by the Rules of Professional Conduct by the Alabama State Bar.



Exception A Member Spouse Coverage ( DOMESTIC RELATIONS RIDER )

If you as member elects to include the DOMESTIC RELATIONS RIDER with your prepaid legal services ; Your spouse CAN NOT be added under the plan as a covered person regarding any other legal representation provided by the FIRM.

If you as the primary member elects to be covered under the DOMESTIC RELATIONS RIDER ; the FIRM can ONLY represent you in ANY legal services provided by the FIRM under the plan.

If you as primary member elects to name your spouse as a covered person under the plan ; and issues of Domestic Relations ( divorce, child custody, child visitations, child support, alimony, etc.) arise between you and your spouse, then the FIRM can not represent you or your spouse in such matters. However, the FIRM can refer you or your spouse to a competent Domestic Relations attorney, upon request.

Alabama Rules of Professional Conduct (1.8(k)) "prevents a lawyer from acting as intermediary in a divorce or domestic relations proceeding or in matters involving custody of children, alimony, or child support." Under this rule only one of the two spouses may be represented by the lawyer.
